Unlawful Presence Provisional Waiver Case Evalution

On January 6, 2012 the USCIS announced it's intent to enact a new regulation that would allow certain persons who are unlawfully present in the U.S. to apply for an unlawful presence waiver prior to departing the U.S. This new regulation has not yet been enacted but if you are unlawfully present in the U.S. it will affect your rights. Please complete this form if you would like to find out if the new regulation will apply to you. The hardship would result from your being separated from your U.S. citizen spouse or parent. The hardship must be to a U.S. citizen who is your spouse or parent.
