Signfiicant Age Difference and K1 Visa

An age difference of 56 years is a lot. This will be a very BIG red flag that will be difficult to overcome. There is no rule of law or regulation that provides that a K1 beneficiary can't be X years older or younger than the petitioner. However, in K1 cases with an age difference as significant as this it becomes exceptionally challenging to prove that the relationship is bona fide. Even if a visa wasn't involved, most people would be suspicious that the primary motivation for the relationship was something other than love. For example, in this country when an older man marries a much younger woman most people will assume it is for the money. In K1 cases, the consular officials will assume it's for the visa and you would have to convince them otherwise with overwhelming evidence of a bona fide relationship. This can be more or less difficult depending on the country that will adjudicate the petition. While this will be a significant issue no matter where this case may be adjudicated it will be exponentially more difficult if the foreign national fiance is a citizen of a country that is considered "third world" or in a country that experiences as high rate of visa fraud.

I would never accept a case like this unless the applicant and petition had known each other for quite a long time, had a substantial history of personal visits and otherwise had significant and compelling evidence of a bona fide relationship.
