Adjustment of Status Interview
During the adjustment of status process all applicants are required to appear before a USCIS officer for an interview. Many people who go through this process are nervous about this interview. In most cases, there is nothing to be nervous about. I believe that the anxiety surrounding this interview is created, largely, because of rumors and misinformation about the interview process. I have heard stories about applicants being separated and asked strange questions about the couples sex life or the other intimate details of the relationship. In my experience these tales are simply not true.
The purpose of the adjustment of status interview is for the USCIS officer to review the case file and make sure all of the required information and documentation is in order. Sometimes this involves asking the applicant and the petitioner simple questions to confirm that the information contained in the application is correct. In other cases, there may be some information or documents that are missing or require further explanation.
Here are some quick tips to help you make sure the adjustment of status interview goes smoothly:
- Carefully review the USCIS adjustment of status interview notice. This notice lists several documents that you are required to bring to the interview. Use it as a check list and prepare a folder to take to the interview with all of the information organized neatly.
- Take a complete copy of the adjustment of status petition and any and all other documentation that you submitted with your case. The USCIS processes thousands of cases and sometimes things get lost. Even if you submitted a document it may not be in their file. Taking all the documents you submitted will allow you to provide the USCIS with any missing documents and avoid further processing delays.
- If you find that the USCIS file is incomplete or they require further information or documentation they should issue a written request for evidence. This request will contain a response deadline and specific filing instructions. Be sure to put this on your calendar and provide the information by the deadline. Be sure to use a mail service that provides you with a return receipt.
- Relax. In most cases the interview is very cordial and short.
When my wife and I had our adjustment interview it took less than 5 minutes. The USCIS officer simply review the case, asked us a few questions, and approved the petition. If you case is properly filed and documented the adjustment of status interview will be no problem.
